Article 1 - Definitions

In these conditions, the following terms will be understood to have the meanings assigned to them below:
1. Cooling-off period: the period within which the consumer can exercise his or her right of withdrawal;
2. Green E-shopping B.V.: the company as described under Article 2, and the operator of the website www.buckleybelts.ch;
3. Consumer: the natural person, not acting in a business or professional capacity, who enters into a distance agreement with Green E-shopping B.V.;
4. Day: calendar day;
5. Right of withdrawal: the possibility for the consumer to dissolve the distance agreement within the cooling-off period and in accordance with Article 6 of these general conditions without giving reasons;
6. Model form: the model form (see Article 8) for withdrawal that Green E-shopping B.V. makes available and that a consumer can complete when he or she wishes to exercise his or her right of withdrawal;
7. Distance agreement: an agreement concluded between Green E-shopping B.V. and the consumer within the framework of a system organised by Green E-shopping B.V. for remote selling of products and/or services, with, up to and including the conclusion of the agreement, only one or more remote communication technologies being used;
8. Remote communication technology: means that can be used to conclude an agreement, without the consumer and Green E-shopping B.V. converging in the same space at the same time;
9. Website: the website of www.buckleybelts.ch

Article 3 – Applicability
1. These general conditions apply to all offers of Green E-shopping B.V. on the website, all orders place by the consumer on the website and to every distance agreement concluded between Green E-shopping B.V. and the consumer.
2. Prior to the conclusion of a distance agreement, these general conditions will be made available to the consumer by Green E-shopping B.V. in such a manner that the consumer can save them and review them at a later time. The general conditions will be made available to the consumer in the same language as that in which the agreement is concluded with the consumer.
3. If one or more provisions of these general conditions is or are invalid or nullified in whole or in part at any time, the agreement and these conditions will remain in force as regards the remaining provisions and the relevant provision will be replaced without delay in mutual consultation by a provision that approximates the purport of the original provision as closely as possible.

Article 4 – The Offer
1. The offer is without obligation. Green E-shopping B.V. will be entitled to withdraw the offer immediately after receipt of the acceptance of the offer by the consumer.
2. The offer contains a complete and precise description of the offered products and/or services. Obvious mistakes or manifest errors in the offer will not bind Green E-shopping B.V..
3. Green E-shopping B.V. strives to present the products on the website as realistically as possible. All images, specifications and other data in the offer are indicative. Minor deviations cannot be a reason for compensation or dissolution of the agreement.
4. Green E-shopping B.V. cannot guarantee that the colours shown are exactly the same as the true colours of the products.

Article 5 – The Agreement
1. The agreement will be concluded as soon as the consumer has accepted the offer of Green E-shopping B.V. and Green E-shopping B.V. has not withdrawn the offer in accordance with Article 4.1.
2. If the consumer has accepted the offer by electronic means, Green E-shopping B.V. will immediately confirm receipt of acceptance of the offer by electronic means. As long as receipt of this acceptance has not been confirmed by Green E-shopping B.V., the consumer may dissolve the agreement.
3. Green E-shopping B.V. may, subject to the restrictions of the law imposed for that purpose, check the creditworthiness of the consumer and enquire after all facts and factors that may be material for concluding the distance agreement in a responsible manner. If, further to such investigations, Green E-shopping B.V. has good grounds to decide against concluding the agreement, Green E-shopping B.V. will be entitled to reject an order or request, stating reasons, or to attach special conditions to performance.
4. Each agreement is entered into under the suspensive condition of sufficient availability of the products in question. If the consumer orders a product that is not in stock, Green E-shopping B.V. will inform the consumer about this. In that case, the consumer will be given the choice of whether or not to wait for the new stock. If the consumer does not wish to wait for the new stock, the purchase price will be refunded to the consumer.

Article 6 – Right of Withdrawal
1. When purchasing products, the consumer has the option of terminating the contract during a period of 14 days without stating reasons.
2. The cooling-off period referred to in paragraph 1 will commence on the day following receipt of the product by the consumer or a representative previously designated by the consumer and communicated to Green E-shopping B.V., who is not the carrier, or:
• if the consumer has ordered multiple products in the same order: the day on which the consumer or a third party designated by the consumer has received the final product. Green E-shopping B.V. may, provided that it has clearly informed the consumer thereof prior to the ordering process, refuse an order for multiple products with different delivery times;
• if the delivery of a product consists of multiple consignments or parts: the day on which the consumer or a third party designated by the consumer has received the final consignment or the final part;
• in the case of agreements for regular delivery of products over a given period: the day on which the consumer or a third party designated by the consumer has received the first product.

Article 7 – Consumer's obligations during the cooling-off period
1. During the cooling-off period, the consumer must handle the product and packaging with care. The consumer will only unpack or use the product to the extent necessary to determine the nature, characteristics and functioning of the product. The assumption here is that the consumer may handle and inspect the product only to the extent that would be permitted in a shop.
2. The consumer will be liable for any reduction in the value of the product resulting from a way of handling the product that goes beyond what is permitted in paragraph 1.
3. The consumer will not be liable for any reduction in the value of the product if Green E-shopping B.V. has not provided him or her with all legally required information on the right of withdrawal before or at the time of concluding the agreement.

Article 8 – Exercise of the right of withdrawal by the consumer and the costs
1. If the consumer exercises his or her right of withdrawal, he or she will be obliged to report this to Green E-shopping B.V. within the cooling-off period, by means of the model form for withdrawal or in another unambiguous manner.
2. After the consumer has reported that he or she wishes to make use of his or her right of withdrawal, the consumer must return the product as soon as possible, but within 14 days of the day following the report referred to in paragraph 1. The consumer will in any case have observed the return period when returning the product before the cooling-off period has expired.
3. The consumer must return the product with all delivered accessories and, if reasonably possible, in original condition and packaging, and in accordance with the reasonable and clear instructions provided by Green E-shopping B.V..
4. The risk and burden of proof regarding the correct and timely exercise of the right of withdrawal lies with the consumer.
5. The consumer will bear the cost of returning the product.
6. If the consumer exercises his or her right of withdrawal, all additional and supplemental agreements will be terminated by operation of law.

Article 9 – Obligations of Green E-shopping B.V. in the event of withdrawal
1. If Green E-shopping B.V. facilitates notice of withdrawal by the consumer by electronic means, then after receipt of this notice it will immediately send a confirmation of receipt of the withdrawal.
2. Green E-shopping B.V. will refund all payments made by the consumer, including any delivery costs charged by Green E-shopping B.V.. Reimbursement will take place as soon as Green E-shopping B.V. has received the returned products, or as soon as the consumer proves that he or she has returned the product.
3. For the reimbursement, Green E-shopping B.V. will use the same payment method that the consumer has used, unless the consumer consents to another method. The reimbursement will be made at no cost to the consumer.3. If the consumer has opted for a more expensive method of delivery than the cheapest standard delivery, Green E-shopping B.V. will not have to reimburse the additional costs for the more expensive method.

Article 10 – Prices
1. The prices stated on the website are in Sterling Pound and include VAT but exclude other additional costs, such as shipping costs. VAT, as well as any shipping costs or other fees or levies that must be paid by the consumer, are stated at the end of the ordering process before the order is finalised.
2. Green E-shopping B.V. makes every effort to list the correct prices on the website. In the unlikely event that an incorrect price is stated on the website, the order will be carried out on the basis of the price stated on the website at the time of the order. In that case, Green E-shopping B.V. reserves the right to adjust the incorrect price on the website. Manifestly incorrect prices will not bind Green E-shopping B.V.. In that case, Green E-shopping B.V. will be entitled to cancel the agreement with the consumer and to make the consumer a new offer. The purchase price already paid will be refunded to the consumer.
3. Green E-shopping B.V. reserves the right to adjust prices at any time. Any price adjustments will not affect agreements already concluded.

Article 11 – Conformity, warranty and liability
1. Green E-shopping B.V. warrants that the products will satisfy the agreement, the specifications stated in the offer, reasonable standards of soundness and/or usability and any statutory provisions and/or governmental regulations in force on the date the agreement was made, all with due observance of Article 4, paragraph 3, of these general conditions.
2. The warranty term of Green E-shopping B.V. matches the manufacturer's warranty term, but will never be shorter than the statutory warranty term. A warranty issued by Green E-shopping B.V., the manufacturer or importer will not affect the statutory rights and claims that the consumer can assert against Green E-shopping B.V. under the agreement.
3. The warranty does not apply if:
a. The consumer has used the product contrary to the normal use of the product;
b. The defect is the result of normal wear and tear;
c. The consumer has repaired and/or manipulated the delivered products himself or herself or has had them repaired and/or manipulated by third parties;
d. The products delivered have been exposed to abnormal circumstances or otherwise treated carelessly or have been treated contrary to the instructions of Green E-shopping B.V. and/or the instructions on the packaging;
e. The unsoundness is wholly or partly the result of regulations imposed or to be imposed by the government with regard to the nature or quality of the materials used.
4. Warranty claims should be reported to Green E-shopping B.V. in writing, within two months after a defect occurs. In the absence of a timely complaint, all claims against Green E-shopping B.V. will lapse.
5. Notwithstanding any other article in these general conditions, Green E-shopping B.V. will not exclude or limit its liability in accordance with or in connection with an agreement, as far as the liability is related to the following matters: i) death or injury as a result of proven negligence towards the consumer; ii) fraud or deceit; or iii) any other matter in which exclusion or limitation of liability (or an attempt to exclude or limit) by Green E-shopping B.V. would be unlawful.
6. Except as provided in the previous paragraph, Green E-shopping B.V. will not be liable in any event towards the consumer (no matter how the liability arises, including tort liability) based on or in connection with an agreement, regardless of whether direct, indirect, special and/or consequential damage is concerned.
7. This article applies subject to the statutory rights of the consumer that may not be deviated from.

Article 12 – Delivery and performance
1. Green E-shopping B.V. will observe the greatest possible care in taking receipt and in the performance of orders for products.
2. The place of delivery will be the address communicated by the consumer to Green E-shopping B.V..
3. The expected delivery date is indicated on the website and will also be stated in the confirmation of receipt. Green E-shopping B.V. strives to carry out your order within 30 days of the order date. The consumer can track the order via the website. If desired, the consumer can choose to be kept informed of the progress of the order by e-mail. If delivery is delayed, or if an order cannot be performed or can be performed only in part, the consumer can check this via the tracking systems referred to above. In that case, the consumer will have the right to terminate the contract at no cost.
4. If the consumer has ordered more than one product, these products can be delivered together or separately.
5. If delivery of an ordered product proves impossible, Green E-shopping B.V. will make every effort to make a replacement item available. No later than upon delivery, it will be stated in a clear and comprehensible manner that a replacement item will be delivered. If the consumer does not approve the replacement item, the purchase price will be refunded to the consumer. In that case, the costs for any return dispatch will be borne by Green E-shopping B.V..
6. If the consumer does not take possession of the ordered product, Green E-shopping B.V. can decide to store it at the expense and risk of the consumer until the product can be delivered again.
7. The risk of damage and/or loss of products rests with Green E-shopping B.V. until the time of delivery to the consumer or a representative designated in advance and communicated to Green E-shopping B.V., unless expressly agreed otherwise.

Article 13 – Payment
1. In so far as not agreed otherwise, the amounts owed by the consumer must be paid immediately after ordering a product and/or service.
2. The consumer will be obliged to report any inaccuracies in the payment details provided or communicated to Green E-shopping B.V. without delay.
3. In the event that the consumer does not meet his or her payment obligations on time, and Green E-shopping B.V. has notified the consumer of the late payment and has granted the consumer a term of fourteen (14) days to make the payments in question, and payment is still not received within this fourteen-day period, statutory interest will be owed by the consumer on the outstanding amount and Green E-shopping B.V. will be authorised to charge on any extrajudicial collection costs incurred.

Article 14 – Privacy
1. Green E-shopping B.V. respects your privacy and personal data. The privacy and cookie statement explains how Green E-shopping B.V. handles the personal data provided by consumers to Green E-shopping B.V..

Article 15 – Complaints procedure
1. Any complaints may be submitted by the consumer via help@buckleybelts.com
2. Complaints submitted to Green E-shopping B.V. will be answered as soon as possible, but at the latest within 14 days, calculated from the date of receipt. If a complaint requires a foreseeable longer processing time, Green E-shopping B.V. will respond within fourteen days with a notice of receipt and an indication of when the consumer can expect a more detailed answer.
3. If Green E-shopping B.V. finds the complaint well-founded, Green E-shopping B.V. will replace or repair the delivered products free of charge, or refund the purchase price to the consumer, all this at the discretion of Green E-shopping B.V..

Article 16 – Governing law and competent court
1. Agreements between Green E-shopping B.V. and the consumer to which these general conditions apply, are governed exclusively by the law of England and Wales.
2. All disputes resulting from or in connection with the agreement and possible other agreements between Green E-shopping B.V. and the consumer will be submitted to the competent court in the consumer's place of residence. This article does not affect your statutory rights.

Article 17 - Amending these general conditions
1. Green E-shopping B.V. reserves the right to revise and amend these general conditions from time to time.
2. The applicable general conditions are those that are in force at the time when the agreement between Green E-shopping B.V. and the consumer is concluded.
