Article 1 - Introduction
www.buckleybelts.com cares a lot about your privacy. We therefore handle the information we receive from or about you with care. This privacy statement describes what information we collect from you, disclose, store and under what conditions we may share this information with third parties. We will also explain how we store your data, how we protect your data against misuse, what security techniques we use, who may access the data and what rights you have with regard to the personal data you provide to us. For the privacy statements of third parties, as well as affiliated businesses, reference is made to the relevant websites. Buckley Belts bears no processing or other responsibility for these websites.Green E-shopping B.V., having its registered office at Turfhaven 198, 2511DK, Den Haag, the Netherlands, and listed in the commercial register under Chamber of Commerce number 90562534 ("Green E-shopping", "Buckley Belts") is the controller responsible for the processing and storage of your personal data. Article 2 - The data that we process
Performance of the agreementFor the performance of the agreement that you conclude with us, we need your first and last name, home or other physical address, e-mail address, telephone number and payment details. If this is necessary for the performance of the agreement to which you are a party, we will pass on this information to third parties, such as payment and delivery services.Your e-mail address will also be used to contact you for a review after you have received the products ordered from us.Visiting Buckley Belts and direct or other marketingWhen you visit Buckley Belts, we store your IP address using Shopify's servers and webshop software. We do so by installing cookies. In some countries, including those in the European Economic Area, these data may be considered personally identifiable data under privacy laws. These data are collected and stored in order to keep track of the number of visits, the average time you (as a visitor) spend on Buckley Belts, the pages viewed and other usage data. We use this information to measure the use of our website and to improve its contents.  We can also collect information that we receive from third parties, including information from our partners and social media sites according to your settings on those websites. We may use your personal information when you use the functions on these websites and/or apps, such as a Facebook like. Whenever you use a function of this kind, we can obtain your personal data via our social media in question.In addition, Buckley Belts buttons are included to promote the web pages of our social media accounts. These buttons work by means of a code from the social media platform. As soon as you click on a button, this code places cookies, allowing the social media platform to receive your personal data. Examples include your IP address. We refer to the privacy statements of the social media platform in question that explain what personal data they collect.Contact formYou can contact us using the contact form on the website of Buckley Belts. In order to provide you with the best possible service, we ask you to enter your name, e-mail address, telephone number and your message for us.NewsletterThrough our website, you can register for our newsletter. The newsletter informs you about current offers, interesting specials and news. To send our newsletter, we need your e-mail address and express consent.In some cases, we process personal data only if you have given your consent. This is the case, for example, when sending newsletters and other communications or participating in available interactive messages online. The consent you have given may be withdrawn at any time. For more information on how to withdraw your consent, please refer to Article 7 - Your rights, in this privacy statement.Application procedureBuckley Belts collects and processes personal data of applicants. We collect, for instance, the name, gender, contact details, motivation letters and CVs. These data are relevant for completing the application procedure and will be deleted by no later than four weeks after that procedure is completed. If you give your consent, Buckley Belts may keep your personal data in its records for longer, so that we can contact you again in the future. In that case, Buckley Belts will not keep your contact details for longer than one year.ContractorsBuckley Belts also processes personal data of contractors, including self-employed workers without staff, in the context of the contract for services. If we enter into a contract for services with a contractor through UpWork, further information about the processing of personal data can be found in the agreement that the contractor has concluded with UpWork.

Article 3 - General purpose of the processing and legal basis
Buckley Belts uses your data exclusively for the benefit of our services, unless we indicate otherwise during the collection of your data. This means that the purpose of the processing is always directly related to the instruction given by you. We will not use your data for purposes other than those mentioned above, pass them on or issue them to other parties, except as indicated below or if we are legally obliged to share the data with third parties. If you share data with us and we use these data to contact you – other than at your request – at a later time, we will ask for your explicit consent. Your data will not be shared with third parties, other than to comply with accounting and other administrative obligations. We process personal data only if there is a legal basis for doing so. We process your personal data: Normally, we will only collect your personal data (i) when we need it in order to perform the agreement concluded, for example when you purchase our products, (ii) when the processing is in our legitimate interest and does not override your rights, for example in order to tailor our marketing to your requirements, or (iii) when we have your consent to do so.In some cases, we may also have a legal obligation to collect personal data from you or we may need the personal data in some other way to protect your vital interests or those of others.If we collect and use your personal data on the basis of our legitimate interests (or those of third parties), these interests generally relate to: managing our webshop and communicating with you in so far as necessary to provide our services to you, answering questions, improving our webshop, carrying out marketing, or with a view to detecting or preventing illegal activities. Article 4 - Sharing data with third parties
Buckley Belts shares your personal data with carefully selected third parties if this is necessary for the performance of the agreement and/or to comply with any legal obligation. We conclude a processing agreement with companies that process your data on our behalf so as to ensure the same level of security and confidentiality regarding your data. Buckley Belts remains responsible for this processing.Buckley Belts may transfer your personal data to processors or parties located in countries outside the European Economic Area (EEA). We will transfer your personal data outside the EEA only in so far as the country in question offers a satisfactory level of protection. Buckley Belts uses model contracts approved by the European Commission for this purpose.ShopifyOur webshop has been developed with Shopify software. Personal data that you make available to us for the purpose of providing our services will be shared with this party. Shopify has access to your data to provide us with technical and other support. They will never use your data for any other purpose. Shopify is obliged to take appropriate security measures based on the agreement we have concluded with them. These security measures consist of the application of SSL encryption and a strong password policy. Shopify is a certified processor of credit card data. Shopify uses cookies to collect technical information regarding your use of the software, no personal data are collected and/or stored. Shopify takes account of the applicable statutory retention periods for personal and other data. We also send our newsletters and transactional e-mails using the webshop software of 'Shopify'. Shopify's servers are also used to send you all the confirmation e-mails you receive from our website, as well as web forms.At the bottom of every e-mail that is sent automatically via our website, you will find the 'unsubscribe' link. If you click on this link you will no longer receive e-mails from our website. This can seriously reduce the functionality of our website. For more information on how Shopify processes, secures and stores personal data, please refer to Shopify's privacy statement.CjDropshippingFor the processing of orders and the delivery of the products ordered by you, we engage CjDropshipping. CjDropshipping ensures that the products are delivered according to your order to an address provided by you.Google - GmailWe use the services of Google-Gmail for our regular business e-mail traffic. This party has taken appropriate technical and organisational measures to prevent as much as possible misuse, loss and corruption of your and our data. Gmail does not have access to our inbox and we treat all our e-mail traffic as confidential.For further information on how Google processes, secures and stores personal data, we refer to Google's privacy statement.Mollie and PayPal - Payment platformWe use Mollie's platform to process payments in our webshop. Mollie processes your name, address and place of residence and payment details such as your bank account number. In case of a request for a deferred payment (credit facility), Mollie shares personal data and information relating to your financial position with credit rating agencies. All of the above guarantees relating to the protection of your personal data also apply to the parts of Mollie's services for which they engage third parties.Because Mollie processes personal data at our request, Mollie is regarded as a processor. Article 5 - Cooperation in tax and criminal investigations
Where applicable, Buckley Belts may be required on the basis of a statutory obligation to share your data in connection with tax or criminal investigations. In such a case, we will be forced to share your data, but we will resist this within the possibilities offered to us by law.

Article 6 - Retention periods
We do not keep your personal data any longer than necessary, unless a statutory obligation requires us to do so for a longer period of time. We will keep your data for as long as you are our customer. This means that we will keep your customer profile until you indicate that you no longer wish to use our services. Pursuant to applicable administrative obligations, we must keep invoices containing your personal and other data for seven years. During this period, however, staff no longer have access to your customer profile and documents that we have produced as a result of your instruction.As referred to above, you can create an account at Buckley Belts. We will delete inactive accounts after a period of two years. However, if you have provided us with your e-mail address (possibly via your account) to enable us to keep you informed of our services, we will continue to keep your data for that purpose.

Article 7 - Your rights
On the basis of applicable Dutch and European legislation, you, as a data subject, have certain rights with respect to the personal data processed by us or on our behalf. We explain below which rights these are and how you can invoke them. In principle, to prevent misuse, we send extracts from and copies of your data to your e-mail address already known to us. In the event that you wish to receive the data at another e-mail address or, for example, by post, we will ask you for identification. We keep records of requests that have been dealt with. In the case of a request for erasure (‘right to be forgotten’), we use anonymised data. You will receive all extracts from and copies of data in the machine readable data format that we use within our systems. Right of accessYou always have a right of access to the data that we process (or have others process) and that relate to your person or can be traced back to you. You can make a request to that effect to our contact person for privacy matters. You will receive a response to your request within four weeks, unless we inform you within that period that we need slightly more time. If your request is granted, we will send you a copy of all data to the e-mail address known to us together with an overview of the processors holding this data and specifying the category under which we have stored this data. Right to rectificationYou always have the right to have the data that we process (or have others process) and that relate to your person or that can be traced back to you, modified at any time. You can make a request to that effect to our contact person for privacy matters. You will receive a response to your request within four weeks, unless we inform you within that period that we need slightly more time. If your request is granted, we will send you a confirmation that the data has been modified to the e-mail address known to us.ErasureYou can request us to delete your personal data from our systems in one or more of the following cases:the personal data are no longer needed for the purposes for which we processed them;you withdraw your consent for processing or further processing and no other basis for processing exists;you submit an objection, stating the reasons, and there are no compelling reasons for not agreeing to your objection;we have processed the personal data unlawfully;we have to delete your personal data on the basis of a statutory obligation;we have collected the data by means of mobile telephony or Internet services.You can submit a request for data erasure to our contact person for privacy matters. You will receive a response to your request within four weeks, unless we inform you within that period that we need slightly more time. If your request is granted, we will send you a confirmation that the data has been modified to the e-mail address known to us.Right to restriction of processingYou always have the right to restrict the data that we process (or have other process) relating to your person or that can be traced back to you. You can make a request to that effect to our contact person for privacy matters. You will receive a response to your request within four weeks, unless we inform you within that period that we need slightly more time. If your request is granted, we will send you a confirmation at the e-mail address known to us that the data will be restricted as long as there is a reason to do so.Right to data portabilityYou always have the right to have the data that we process (or have others process) and that relate to your person or that can be traced back to you, processed by another party. You can make a request to that effect to our contact person for privacy matters. You will receive a response to your request within four weeks, unless we inform you within that period that we need slightly more time. If your request is granted, we will send the personal data collected by us to the third party indicated by you, in a structured, commonly used and machine-readable format. In such a case, we will in all probability no longer be able to continue the service because the secure linking of data files can then no longer be guaranteed.Right to object and other rightsIn some cases you have the right to object to the processing of your personal data by or on behalf of Buckley Belts. If you object, we will immediately discontinue the data processing pending resolution of your objection. If your objection is well-founded, we will provide you with extracts from and/or copies of the data that we process (or have others process) and then discontinue the processing on a permanent basis. You also have the right not to be subjected to automated individual decision-making or profiling. We do not process your data in such a way that we have already implemented this right. Article 8 - Security measures Buckley Belts has technical and organisational security measures in place to protect personal data. Measures we use in various circumstances to protect the data we hold against loss, misuse and alteration include: monitoring, logging and encryption, secure access points to our servers (Tier III, ISO 27001 and PCI-DSS), vulnerability scans and limited employee access rights. However, no system is perfect or can guarantee that unauthorised access or theft of data is excluded. Despite the fact that Buckley Belts has security measures in place to protect personal data, we always advise our visitors and customers to take measures themselves to protect their personal privacy (i.e. keep access codes and/or PIN codes secret).  

Article 9 - Cookies
We collect data for research purposes in order to gain a better understanding of our customers so that we can tailor our services accordingly. We therefore use functional, analytical and tracking cookies (small text files placed on your computer) to help the website analyse how visitors use the site. The information generated by the cookie about your use of the website can be transferred to secure servers of Buckley Belts or those of a third party.No permission is required for placing functional or analytical cookies.
